The terms and conditions for website users that must be fulfilled at all times are detailed below.
II.-CONDITIONS OF USE
1.- WEBSITE CONDITIONS
The conditions of use regulate the utilisation of the website that the FUNDACIÓ BARCELONA OLÍMPICA (hereinafter the FBO) places at the disposition of its users.
The legal notice, the conditions of use, the digital contracting conditions, the processing of personal data, and the cookies policy, constitute as a whole, the terms and conditions that govern the access and use of the public part of the website.
The access and use of the website by the User assumes that he/she accepts the Terms and Conditions of the website in their entirety, and agrees to fully comply with them. The User must therefore read the present Conditions of Use carefully, in addition to the other Terms and Conditions of the website each time that he/she decides to use the latter, as these may be subject to modifications. The FBO reserves the right to update, modify or delete the present Terms and Conditions of the website.
The User is hereby informed and accepts that until all the requirements that have been established by the FBO in all cases, the sending of a request, or a request to contract any of the products or services included on the website does not imply the ‘initiation of a commercial relationship of any kind with the FBO.
The User undertakes to make proper use of the website, the term ‘proper use’ being understood to mean that which is in accordance with current legislation, good faith and public order. The User also undertakes not to use the website for fraudulent purposes, nor to perform any actions that may damage the image, interests and rights of the FBO or those of third parties. Furthermore, the User undertakes not to carry out any actions that aim to damage, render unusable or overload the website, or that in any way prevent the normal use and operation of the latter.
The User is informed that, if he/she infringes the content or those obligations that arise from the Terms and Conditions of the website, or any other terms or conditions included in the website, the FBO reserves the right to limit, suspend, or terminate his/her access to the website, by adopting any technical measures necessary for this purpose. Likewise, the FBO reserves the possibility of exercising these measures in the event that reasonable suspicion exists that the User is infringing any of the Terms or Conditions of the website, or any specific terms or conditions that are included on the website.
The FBO reserves the right to update, modify or eliminate the information contained on the website, including the contents and/or services that form part of it. It also reserves the right to limit or to withhold access to this information at any time and without prior notice. The FBO specifically reserves the right to eliminate, limit or prevent access to the website when technical difficulties arise due to events or circumstances beyond the control of the FBO and that, in its opinion, reduce or nullify the security levels or standards adopted for the proper operation of the website. To this end, the FBO reserves the right to decide, at all times, on the continuity of the services of the information society that it provides through the website.
2.- RESPONSIBILITY
The User must be aware that communications made using open networks are exposed to a wide range of threats, this means that they are not entirely secure.
As such, it is the responsibility of the User to adopt the appropriate technical measures to reasonably limit and prevent these threats. Furthermore, the User must possess updated detection systems against malware such as viruses, Trojans, etc., and must have updated the security patches of his/her browsers. To this end, the User is recommended to visit his/her Internet service provider, who will be able to provide solutions that meet each individual’s needs, and review these solutions on a regular basis. Within the maximum scope permitted by applicable legislation, the FBO cannot be held liable for damages caused to the User as a result of those risks inherent in the means utilised for website access, or those that are caused by vulnerabilities in their systems and tools. Furthermore, the FBO does not guarantee the total security of its systems, and despite the fact that it has adopted adequate security measures, the existence of vulnerabilities cannot be totally ruled out and as a result, the User must be cautious and diligent in their interactions with the website.
The website may only be used for personal and non-commercial use. In no event may the User disclose commercial information or undertake any activities on the website, in any form and in any condition.
The FBO assumes no responsibility that may arise from:
- The incorrect use of the contents of its website, and it reserves the right to modify, delete, or limit, or eliminate access to it temporarily or definitively when it deems such actions appropriate, this also applies to any technical issues that may affect the User during his/her connection to the website https://www.museuolimpicbcn.cat
- Those damages that may be caused by third parties through illegitimate interference or acts of criminal impersonation that escape the controls of the FBO.
- Security errors that arise from the use of computers or other devices that are infected by computer viruses (worms, Trojans, etc.), or through the use of non-updated versions of browsers that may cause malfunctions, in addition to incorrect browser use.
- Those discrepancies that may occur temporarily between the conditions of the products and those services offered by the FBO and those published on the website.
The FBO hereby informs the User that the function of the links that appear on this page to other third-party, non-FBO websites is to solely facilitate access to information, utilities and services, without this involving, in any event, suggestions, invitations or recommendations with respect to such pages. Therefore, in no event does the FBO guarantee the information services or products that may exist on these websites, and as such it may not be held liable for any damages or losses that may arise as a result of the contracting of services and products, the use or the simple access to the aforementioned information, nor for the non-compliance with current legislation by these third parties, especially that relating to the protection of personal data and electronic commerce.
The FBO is not obliged to control the use that third parties make of its website, and consequently, it is not responsible for the misuse undertaken by these third parties, it being the full responsibility of the latter to comply with the conditions detailed in this legal notice. The FBO is specifically not responsible for the content or statements that may be made in any forum or debate linked to this website, and prohibits any transmission of data that users may undertake that infringes the rights third-party ownership, or the content of which is illegal, defamatory or immoral, reserving the right to prevent or prohibit access to any user who introduces content that is contrary to legal norms or moral standards, reserving the right to exercise those legal measures that it considers opportune in order to prevent and avoid such conduct.
3.- SECURE ENVIRONMENT
The FBO provides a secure environment for any operations and queries made through its website, and in all those forms that contain personal data.
All of this information is transmitted using data encryption using the encryption protocol required for this purpose, which guarantees the confidentiality of all messages, so preventing third parties from seeing or capturing any information exchanged.
4.- THE RIGHTS OF THE FBO
- To preserve, modify or suspend its website without prior notice.
- To modify the price of its offers.
- To reject orders due to lack of stock or client non-payment.
- To refuse access to computer tools to customers when these conditions are infringed.
- To charge those amounts due from customer purchases, after transactions are accepted.
- To correct or amend errors of any kind, be they manmade or technological in origin.
5.- INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS
The FBO possesses the intellectual property rights over the “Contents” of the website, this being understood without limitation as including the texts, documents, images, videos, sound recordings, the graphic design and user interface of the website, the website code – including the provision of the contents in the website itself – the sui generis rights on the underlying databases, the underlying computer programs (including the source codes and object codes) and, in short, all those elements that comprise the website, such that any reproduction, distribution, public communication, and transformation is prohibited, without the prior authorization of the FBO those responsibilities that may arise will occur as the result of the application of intellectual property law on any infringements that may be made. Similarly, all commercial names, trademarks or distinctive symbols or signs of any kind contained on the web page are protected by law and are duly registered in the name of their owner, those responsibilities that may be appropriate will arise as a result of the application of industrial property law on any infringements made.
The use of the website by the User does not imply the transfer of any intellectual and/or industrial property rights over the website, or of the contents and/or the distinctive signs of FBO. To this end, and except in those cases where legal authorisation exists, or where previously authorisation by FBO has been granted, the reproduction, transformation, distribution, public communication, making available, extraction and/or the reuse of the website, its contents and/or the distinctive signs of the FBO, or of any other third parties included in the website is expressly prohibited. The FBO reserves the right to exercise those legal actions that correspond to those Users that violate or infringe intellectual and/or industrial property rights.
The User may not refer to him/herself as an authorised FBO representative in promotions or advertisements, or use the logos, trademarks, service marks, or any other variant of the latter, nor launch any public advertisement that refers to FBO or this contract without having first obtained written consent from the FBO.
The FBO reserves the right to use and reproduce free of charge, any images and videos related to its facilities that users publish on social networks and on the Internet.
6.- THE ESTABLISHMENT OF LINKS WITH THE WEBSITE
The establishment of links to the website is prohibited, unless the latter has previously been authorized by the FBO. In the authorization granted by the FBO for the establishment of the link, which must be formalized in an express and written manner, the conditions of such a link with respect to frames, views and the control of those contents to be linked must be agreed in detail.
7.- LINKED SITES
The website may host links to third-party sites. On clicking on these links, the User acknowledges that the FBO cannot guarantee their content, and therefore accepts access to them at his/her own risk. In these cases, the FBO would act as a provider of intermediation services, as established in Article 17 of Law 34/2002, of 11 July, on the Services of the Information Society and Electronic Commerce. In accordance with that provided in the aforementioned legislation, the FBO will not be responsible for those services and content facilitated through the linked sites.
The existence of linked sites does not entail recommendation, promotion, identification or the compliance of the FBO with the manifestations, content or services provided through the linked sites. The FBO is therefore not responsible for the content of the linked sites, or its terms of use and privacy policies, the User being the sole person responsible for checking and accepting them every time they access and make use of these sites.
8.- THE COMMUNICATION OF ILLICIT AND INAPPROPRIATE ACTIVITIES
If the User is aware that any information or content on the website, or that any information or content provided by means of the website is unlawful, or that it infringes the rights of third parties or is contrary to the provisions of these Terms of Use or, in any other way, contrary to morals, uses and good customs, he/she may contact the FBO, detailing the following points:
- Their personal data and contact information of the informant.
- A description of the actions considered inappropriate, in addition to the specific address where they are available
The reception by the FBO of the abovementioned information will not imply its effective knowledge of the activities and/or of the content detailed by the informant when this is not tangible and evident. In all events, the FBO reserves the right to suspend or remove those contents that, despite not being illegal, are contrary to the norms established in these Terms of Use, taking any conflicting legal interests into consideration in each case.
9.- COMPREHENSIVE NATURE – INTEGRITY
If one or more of the provisions of these Conditions are declared null and void by virtue of the application of a law, regulation or any other normative provision, or after a final judicial or administrative ruling has been made, the remaining provisions will retain their validity and scope.
The fact that a party may not have demanded the application of any clause in these Conditions on either a permanent or temporary basis cannot be considered as a waiver such a clause in any event whatsoever.
10.- APPLICABLE LEGISLATION AND JURISDICTION
In accordance with that established in Article 3 of Law 34/2002 of 11 July on the Services of the Information Society and Electronic Commerce, the laws applicable to the services of the information society as provided by the FBO through the website will be those of Spain.
With respect to any matters that may arise with respect to the terms contained in these Conditions, in addition to those that may arise from any contracting and provision of the services offered by the FBO, the parties expressly and exclusively submit to the courts and tribunals of the city of Barcelona and to those bodies that are their hierarchical superiors, waiving any other jurisdiction or venue that may be applicable to them.
III.- GENERAL CONDITIONS OF ELECTRONIC CONTRACTING
1. GENERAL PROVISIONS
These general conditions are applicable to the acquisitions of products and/or services made using this Internet page, between the company FUNDACIÓ BARCELONA OLÍMPICA (hereinafter the FBO) and all those persons who make purchases using the website: https://www.museuolimpicbcn.cat
These conditions have been drafted in accordance with that established in Law 3/2014 of 27 March, which modified the consolidated text of the General Law for the Defence of Consumers and Users and other additional laws, Law 34/2002 on the Services of the Information Society and Electronic Commerce and Law 7/1998 on General Contracting Conditions and all those regional and state dispositions that may be applicable.
The contractual documentations used to the contract procedures used to acquire products and/or services on the website https://www.museuolimpicbcn.cat, and which belongs to the FBO, are outlined below.
The acceptance of this document implies that the purchaser states:
a. That he/she is a person with sufficient capacity to enter into a contract.
b. That he/she has read, understands and comprehends the contractual conditions detailed herein.
c. That he/she accepts the obligations established herein.
The FBO reserves the right to modify these Conditions unilaterally, without this implying any modifications being made to the acquisitions of goods and/or services carried out prior to any modifications that may be made. That is, in the event of any modifications made to the Conditions by the FBO, those conditions that are applied to each User, will always be those that he/she accepted at the time his/her purchase was made.
The User, prior to entering into this contract and in all events, during the purchasing process, will be able to access, file and print these Conditions for consultation. These Conditions will be available in Catalan, Spanish and English.
If any of the clauses or Conditions of this contract are declared illegal or void, the contract will remain applicable with respect to all its remaining clauses.
2. THE IDENTIFICATION OF THE PARTIES
On the one hand, the FUNDACIÓ BARCELONA OLÍMPICA (The Barcelona Olympic Foundation, hereinafter the FBO), with Spanish tax identification nº (CIF) G-60309655, with its official address at El Museu Olímpic de l’Esport Joan Antoni Samaranch, Avinguda de l’Estadi, 60 – Barcelona 08038, entered under Registration number 705 in the Catalan Government Registry of Foundations (for more information see the General Information section).
And, on the other hand, the User, who registered on the website under his/her own name, being responsible for the veracity of all the information and declarations provided. The User states that he/she is aged eighteen years or over and possesses the legal capacity to make a purchase using the website https://www.museuolimpicbcn.cat
3. THE PURPOSE OF THE CONTRACT
The purpose of this contractual agreement is to regulate the contractual purchase and sale conditions between the provider (FBO) and the User at the moment when the latter affirms his/her acceptance of a purchase by clicking on the corresponding box during the online contracting process.
The purchase of the products and services offered on the website https://www.museuolimpicbcn.cat entails their delivery by the FBO, and obliges the user to pay the price of the product and/or service that is publicly announced on the abovementioned website, and to make use of the website itself in accordance with the law and with these conditions.
Each product and/or service may be subject to a specific regulation that is applied through the specific conditions that correspond to the contractual agreements pertinent to each product/service.
If the User acquires any product and/or service through a third party, the latter will be responsible for providing the User with a copy of these General Conditions. The FBO will not, in any event, be answerable for any consequences for the User that may arise from the non-assumption of those obligations detailed in this paragraph by the third party with whom he/she has made a purchase.
4. CONTRACT PROCEDURE
Our purchasing process is quick and easy:
4.1 Ticket Purchases
In order to buy the tickets to visit the Olympic and Sports Museum, users must first access the page https://www.museuolimpicbcn.cat, and click on the “Buy tickets” button in yellow at the top of the page. Tickets may also be purchased on a lower section of the web page.
Once the abovementioned button has been clicked, general ticket information appears, and the User may then choose the number of tickets required using the (+) and (-) buttons. The options provided are as follows:
- Individual ticket for children over 7.
- Individual ticket for students (verification of student status is essential).
- Individual ticket for children under 7.
- Group ticket for groups of 10 people or more.
In all those cases where a discount is applicable, verification will be required at the checkpoint/box office. If verification is not possible, the ticket holder will be required to pay the difference in order to access the museum facilities. In no event may ticket holders benefit from more than one discount, i.e., the discounts are not accumulable.
With respect to other discounts and gratuities other than those mentioned above, the FBO recommends Users consult the practical information section of the web page, where these offers are detailed. Tickets need to be purchased directly from the box office to obtain free gratuities and discounts that are not available through online ticket purchases, With respect to school visits we recommended visiting the Learn section.
To use the ticket or service, you must deliver the original voucher (in paper or digital format) with the proof of purchase and the document verifying User identity. The ticket may only be used during the schedule established by the Olympic Museum on its website and is subject to capacity limitations.
We recommend groups of more than 20 people to notify us in advance on the day and time of their visit by writing to reserves@fbolimpica.es
Once the User has selected the number of tickets he/she wishes to purchase, the shopping cart will appear on a lower part of the web page.
4.2 Summary
Users will be able to view their product in the shopping cart, and, if applicable, the tickets of each type that have been added, together with the prices, the amounts of items selected and the total price. At this stage users may modify the amounts or delete any unwanted articles. After any changes have been made, click on Update Cart.
Enter the discount voucher code during this part of the process, if applicable.
If, at this part of the process the User wishes to stop shopping, he/she should click on the button Finalise purchases.
4.3 Checking the billing details
The User will then be requested to provide personal information (the obligatory fields are marked with an asterisk):
- Name
- Surname/s
- Company name
- Country
- Address
- Post code
- Order notes
La FBO expedirá factura simplificada a los Usuarios a través de correo electrónico conjuntamente con la entrada.
Una vez rellenados los campos anteriores, el Usuario encontrará un resumen del pedido, en el cual se identificará el/s artículo/s adquirido/s, su precio total (impuestos incluidos). El Usuario tendrá que comprobar que todos los datos sean correctos.
At this point, the User will have to check the box to confirm the acceptance of the conditions of sale that regulate the service and the privacy policy, and which are accessible through the enabled link, (these are also accessible for free and at any time on the corporate website) https://www.museuolimpicbcn.cat/en/tickets/. The User is guaranteed the right to request a copy of this information in a paper format at any time.
If the User then wants to continue with the purchase, and all the information has been verified as being correct, click on the Proceed with the Order button. At this stage in the process, the Users can still go back and either continue with their purchases, and as a result cancel the process.
4.4 Payment
4.4.1 General Provisions
- The payment order provided by the User necessarily implies the observance of these General Conditions and the specific conditions of the order.
- With respect to any form of payment chosen by the User, all payments will be subject to the terms and conditions applicable to the User by those financial institutions or secure payment platforms involved.
- Once the payment has been processed correctly, the User will receive an informative confirmation email that verifies the essential conditions of the operation.
- The FBO reserves the right to cancel payments or orders if it suspects fraudulent operation and it will inform those authorities responsible about such conduct in order to prevent fraud.
- If a payment platform refuses card payment, the order will automatically be cancelled, and the User will be immediately informed of the cancellation by online communication.
- User card data will not be stored in the FBO database, as this data is stored on the secure website of the bank chosen. User card details are protected at all times by means of the secure servers of the banking entities that use an SSL encryption in their communications.
4.4.2 Payment Type and Details
Purchases must be paid using a credit or debit card (VISA, MASTERCARD, 4B, Diners Club, and TCB). No other forms of payment are allowed.
At this stage, the User will connect to the payment gateway of the bank through which the FBO offers this payment method and pay for their reservation. The following information will be requested:
- Card number
- Expiration date
- The 3-digit security code (CVV) on the reverse side of the card.
The purchase cannot be processed if the data detailed above has not been provided.
Once the data has been detailed and verified, the User must click on the Accept button, in order to make the payment.
Next, authentication is checked, authorization is requested, and finally the result of the transaction appears
4.5 Purchase Confirmation
Finally, a thank-you message will appear on the screen and confirmation will be sent if the payment and the processing of the order has been successful.
Once the payment has been made correctly, the User will receive an email detailing purchase confirmation.
As stated above, the User will receive another email in which the simplified invoice of the purchase made will be attached, together with details of the product characteristics, the price, and the date of the contract procedure.
5. AVAILABILITY
When the tickets are purchased, a specific day and time will NOT be assigned for their use, however they must be used within a maximum period of 180 calendar days from the date of purchase, in accordance with the schedules posted on the website https://www.museuolimpicbcn.cat.
These schedules may however be modified due to exceptional circumstances, and especially due to events at the museum’s facilities, details of which will be posted on the website itself.
The User will therefore be solely responsible for verifying the schedules of his/her definitive visit beforehand. We recommend sending an email to reserves@fbolimpica.es to check on museum attendance numbers.
6. PRICE
6.1 Currency and Taxes
The prices of the products offered on the FBO Internet page are detailed in euros (€), including the Value Added Tax (VAT) applicable.
Prices may change at any time, however such changes will not affect those orders or purchases for which the User has already received an order confirmation.
7. RIGHT OF WITHDRAWAL, CANCELLATION AND CHANGES
7.1. Exercising the right to withdrawal
The User is entitled to totally or partially renounce (i.e. withdraw from) the purchases made from the FBO online within a maximum period of 72 hours before the limit date for the use of the entry ticket and without the need to justify this decision. Obviously, this option only applies if the entry ticket has not been used.
Once the abovementioned period has elapsed, the entry ticket/s will not be exchanged for any others, nor will the amount paid be refunded.
In order to exercise the right of withdrawal (renouncing a purchase), the User must notify his/her decision by email to the account comptabilitat@fbolimpica.es with the words indication Purchase Withdrawal and detail the number of the purchase, or the order that appears in the confirmation email that was sent to him/her.
Once the declaration of withdrawal, or the request for refund by the User has been received, the FBO will confirm its receipt by sending an email to the User.
7.2 The Consequences of Withdrawal
The refund of the amount paid by the User will always be made using the same payment method that was employed for the purchase.
If the User exercises his/her right to withdraw from the purchase made, the FBO will reimburse the amount previously charged to the User, including the delivery costs (with the exception of any additional expenses resulting from the User’s decision to use a delivery method different from the less expensive method of ordinary delivery), in a term not exceeding fourteen (14) calendar days from the date that he/she informed the FBO of his/her decision to withdraw from the purchase contract.
The User must assume those direct costs associated with the return of the order, where applicable.
The refund will not be valid if it is made after the period stated above, and those exceptions to the right of withdrawal established by the regulations for consumers and users must be taken into consideration.
8. CONDITIONS OF ACCESS IN THE FACILITIES OF THE OLYMPIC MUSEUM
- The Olympic Museum reserves the right to admission at all times.
- Smoking, eating or drinking is not permitted inside the facilities, nor is access with food or drinks permitted.
- Backpacks and other items of luggage must be left in the locker next to reception.
- Photographs may be taken in the rooms of the museum.
- You may not enter the museum with animals, with the exception of guide dogs.
- The FBO may deny access or expel from the facilities any ticket holder if these conditions are infringed, or if the instructions of Olympic Museum staff are ignored.
- Any attempt to defraud, cheat, steal or damage private property either directly or indirectly in the facilities of the Olympic Museum will legitimize the FBO to adopt those measures and initiate those legal actions that it deems appropriate against those responsible for such actions.
- Tickets that have been purchased at reduced rates must be verified at the museum’s access checkpoint.
9. THE USE OF PURCHASED TICKETS
- Tickets for visiting the Olympic Museum visit are fitted with different security features to preserve their validity and authenticity. The FBO is not responsible for those tickets that have not been acquired at official outlets or through authorized agents, or for those that have not been printed directly by the User through this website. Any damaged ticket, broken ticket or any ticket bearing signs of falsification will legitimize the FBO to take action preventing its holder from entering the venue. In the event of counterfeits the FBO reserves the right to adopt the corresponding legal measures.
- The ticket/s purchased by this means must be held until the day of the visit as if they were cash. The User assumes all responsibility in the event of duplication, photocopies or the falsification of the ticket, and will forfeit all the rights granted to him/her by possession of the ticket with respect to entering the property.
- The FBO cannot be held responsible for the loss or theft of any tickets, nor of any personal property.
- The illegal sale (or attempted illegal sale) of a ticket constitutes a cause for the confiscation or cancellation of the ticket, without the right to reimbursement or any other type of compensation. In order to prevent illegal ticket resale, the acquisition of tickets may be limited in terms of quantity, with a maximum amount per person and/or debit or credit card. The realization of purchases contrary to the criteria established by the FBO and detailed on this website will legitimize the FBO to cancel these tickets, duly alerting the User.
- The acquisition of tickets does not entitle the User to use the tickets or their contents for advertising, marketing or promotion purposes (including competitions, gifts and/or lotteries), without the express written consent of the FBO. Failure to comply with this prohibition will legitimize the FBO to render the ticket/s void and to take any legal actions that it deems appropriate with respect to any damages and losses that such actions may have caused to the FBO.
10. PERSONAL DATA
The FBO will process User data in order to correctly administer the purchasing process, and to meet tax and billing obligations. The information provided is necessary for managing the transaction process of the purchase made.

11. CUSTOMER SERVICE
Users may contact our Customer Service Department at any time, to request help, offer suggestions, or lodge complaints, by writing to comptabilitat@fbolimpica.es, or by calling (Spain) 934.260.660, from Monday to Friday, from 9.00 to 14.00.
12. COMPREHENSIVE NATURE – INTEGRITY

With respect to any matters that may arise with respect to the terms contained in these Conditions, in addition to those that may arise from any contracting and provision of the services offered by the FBO, the parties expressly and exclusively submit to the courts and tribunals of the city of Barcelona and to those bodies that are their hierarchical superiors, waiving any other jurisdiction or venue that may be applicable to them.
